Terms & Conditions

Your CPP Mobile Assistance service is provided by Card Protection Plan Limited ('CPP'), Registered Office: Holgate Park, York YO26 4GA (registered number 1490503) ("we/us/our"). The service is subject to these terms and conditions. It is important that you read each section of these terms and conditions carefully to understand the features and conditions of the Service.


The Service

Who is covered

  1. The primary account holder and any other named persons on the account where applicable.
  2. You must be 18 years of age or older and resident in the United Kingdom.
  3. The Service is non-transferable; this means that you cannot give your entitlement to the Service away to someone else.


CPP Mobile Assistance features and exclusions

You do not have to register with us in order to receive the Service, but it may enable us to provide you with faster assistance if you register your details with us (including the IMEI number of your mobile phone handset, mobile phone number, mobile phone network provider and the name and at least one contact number of your chosen contact for the Safe and Well Message element of the Service). You can register these details with us by calling us on the 24/7 Helpline.

1. 24/7 Helpline

What we will provide

We will provide a 24 hour helpline 365 days of the year for you to request use of the Service. You can call us anytime on 0844 848 1514 for immediate assistance.

Please note that we record all calls and the section on 'Recording Calls' provides you with information on why we do this.

Conditions and limitations

If you are using a mobile phone to call the 24/7 Helpline from abroad, you may be subject to roaming charges from the phone provider. We will not be responsible for these charges.

2. Safe and well message service

What we will do

In the event your mobile phone is lost or stolen, we can pass a message to a chosen friend or relative, whom you have registered with us, to let them know that you are safe and well. You may register two telephone numbers for your chosen contact.

We will choose the method to pass on the message to your chosen contact which will be either by telephone or by text message.

If you want us to, we will try the number(s) registered for your contact once and if we are unsuccessful in contacting them, will try each number again, 2-4 hours later. If we have still been unsuccessful in contacting them, we would not make any further attempts.

If you have not registered any contact telephone number(s) for your contact, then we may be unable to help you.

Conditions and limitations
  1. We will not:
    make any outbound calls between the hours of 10pm and 8am, unless you ask us to do so
    leave voice mails;
    pass messages back to you from your contact.
  2. The content of the message will be limited to telling your contact that you are safe and well, where you are, when you may get in touch with your contact and how they can get in touch with you.

3. Mobile phone blocking assistance

What we will do

When you report a mobile phone handset loss to us, we will try to connect you to your network provider so that you can report the loss to that network provider.

If you have registered your IMEI number with us, we can provide it back to you and help speed up the process of blocking of your mobile phone by your network provider.

Conditions and limitations

You can only report the loss or theft of a mobile phone handset to us if you are the owner of the handset, as network providers will not accept instructions from third parties.

4. CPP Data Back-up Service

What we will provide

We will give you access to an internet service which allows you to back-up calendar and contact data on your mobile phone online. This element of the Service is operated by IMImobile SAT Limited (company number: 6913318). The data you back up will be securely stored while you are entitled to use the Service. Please see the instructions on the website www.cppdatabackup.co.uk for details of how to use this feature.

To access this element of the Service, log on to the data back-up website at www.cppdatabackup.co.uk and complete a registration process. During this registration process, you will be asked to enter certain numbers from the card number on your Card and information about yourself. You will also be asked to create a username, password and to create security questions and answers which you can use to access this element of the Service in future.


Conditions and limitations

  1. This element of the Service is dependent on you registering the details required on the data back-up website and following the instructions on the website to carry out the data back-up.
  2. When you register to use the data back up service, you will be required to agree to be bound by Mobytec's terms and conditions.
  3. The method by which you can back-up your data depends on the type of mobile phone that you have.
  4. Data must be held on the phone memory, not the SIM memory, for data back-up.
  5. You cannot back-up any data which is protected by copyright, for example, games, music and ringtones, or data which is defamatory, offensive, obscene, indecent or otherwise unlawful or objectionable.
  6. The amount of data which you can back-up via the data back-up website is restricted to a certain limit. Please see the data back-up website for details.
  7. To ensure that the data stored on your behalf using this element of the Service is up to date, you must ensure that you back up the data held on your mobile phone on a regular basis.
  8. You can only back up data that is held on the mobile phone which you have registered on the data back-up website.
  9. We will not be responsible for any damage, loss or corruption of the data which you back up using this element of the Service.
  10. Your data will be erased from the data back-up website if we receive notification that you no longer hold the Card.

General Conditions, Exclusions and Limitations

Your attention is particularly drawn to these conditions, exclusions and limitations which detail the general conditions, exclusions and limitations of the Service.

You must meet the following conditions:

a) You must provide full and accurate information in connection with your use of the Service;

b) You must meet all of these terms and conditions.


Period of Service

The Service will be available to you from the date on which you are accepted for the Card and will continue for the period that you remain a holder of the Card.


Cancelling the Service

1. We will cancel the Service if we receive notification that you no longer hold the Card.

2. We will cancel your access to the Service if you have at any time:

a) given us false or incomplete information;

b) used the Service dishonestly or agreed to help anyone try to use the Service dishonestly; or

c) failed to meet the terms and conditions of the Service or to act openly and honestly towards us.


Setting aside terms and conditions

If we choose to set aside a term or condition contained in these terms and conditions, this will not prevent us from relying on that term or condition in the future.

We will do our best to answer your query within five working days. If no reply has been sent by then, you will be sent an acknowledgement letter to keep you informed of progress.


Applicable law

These terms and conditions are governed by and must be interpreted in accordance with the laws of England and Wales, unless you live in Scotland (in which case Scottish law will apply) or unless you and CPP agree otherwise. You and CPP agree that terms and conditions will be issued in English.


Recording calls

We record all phone calls to us. We do this to:

  • provide a record of the instructions received from you;
  • monitor quality standards;
  • help us with staff training; and
  • meet legal and regulatory requirements.

All communications and documents will be in English unless otherwise agreed.


Special needs

We are committed to meeting the needs of all our customers, including those with special needs.   Letters and other documents are all available on request in Braille or large text or on audio tape.   Hearing and speech-impaired customers who wish to speak to us and have a textphone available can do so by using the RNID's Typetalk Relay service.  This is available 24 hours a day, seven days a week and allows our customers who find this convenient to contact us via a Typetalk Operator who will relay instructions and other requests verbally to our call centre staff.  Please note that to use Typetalk Relay, you must have or be able to get access to a textphone.  If so, just dial 18001 and then dial CPP's number; once the call is connected, a Typetalk Operator will join the call to relay your message.  CPP's responses will then appear as text on your textphone.  For Typetalk, please call 18001 0844 848 1514.  For all other services, including requests for Braille, large print or audio versions of any of our documents, please call 0844 848 1514.  In all cases, we'll be happy to help.


Data Protection Notice – Your personal details

We will use the information you provide to: provide the Service to you; and manage your contract with us; transfer information to Vanquis Bank Limited

CPP may use your details to invite you to take part in market research and to let you know about other goods or services that might interest you.

 

CPP may pass your personal information to other members of the CPP group of companies or other organisations acting for members of the CPP group of companies.  They may contact you by post, phone or by email.  By registering to use the Service and by giving CPP your address, phone number and email address, you agree that CPP, other members of the CPP group of companies, and other organisations acting for members of the CPP group of companies, may contact you using these methods.  If you do not want your details to be used for the purposes of market research and marketing, please let us know at any time.

To avoid contacting you unnecessarily about products and services you may already have, we will compare your details with information on prospect files prepared by our business partners. When we do this we may need to tell our business partners that you have a contract for the Service with us and disclose enough personal data to enable our business partners to identify you on these files.

By registering to use the Service you consent that, for the better performance of this contract, we may transfer your data outside the European Economic Area. If so we will make sure that your data receives no less protection than is required in the EEA.

Mobytec Terms & Conditions

These are the terms and conditions ("T&C's") for the CPP Data Backup website (the "Site"). The site is run by IMImobile SAT Limited (company number: 6913318) ("IMImobile SAT", "Mobytec", "We" or "Us"). It is important to remember that by using the Site and any of the products or services available via the Site you agree to be bound by these T&C's so do try and have a quick look at what we've written. If you do not wish to be bound by the T&C's you should not access or use the Site. We've done our bit and tried to make them as short and easy to read as possible.

The Service

We offer all members the ability to safely back up, store, and manage their mobile phone address book and calendar online (the "Service").

We may modify or discontinue our services or your account with us, with or without notice, without liability to you. Your statutory rights are not affected.

On termination of the Services your right to use the Services immediately ceases and we shall then have no obligation to maintain any content or data in your account or to forward any unread or unsent messages to you or any third party.

We will send you reminders to renew your subscription as the subscription period approaches completion.


What we ask of you in return

When using the Site you agree:

  • to use the Site entirely at your own risk at all times
  • not to do anything which will or might damage, interfere with, disrupt access to, interrupt
    or impair the functionality or the material available on the Site
  • to be entirely responsible for and keep secret any password used by you. You should
    change your password if you believe it's no longer secret
  • not to post, distribute or otherwise upload any defamatory, offensive, infringing, obscene,
    indecent or otherwise unlawful or objectionable material or information or send any chain
    letters, junk mail, 'spamming' material or any other form of bulk communication
  • not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others,
    including individuals' privacy rights
  • to supply only truthful and non-misleading information at the time of registration and
    at any other time we ask you for information
  • not to obtain or attempt to obtain unauthorised access to the Site or any private or
    member account areas on the Site
  • not do or cause or permit to be done anything that may infringe, damage or interfere
    with any of our intellectual property rights or those of our associated companies or third
    parties. You also agree not to do anything that is unlawful or which may cause any liability
    for us
  • to ensure that it is legal for you to view and use the Site from wherever you do this.
  • to keep us and our officers, employees and licensors fully indemnified on demand at all
    times in respect of any loss, damage or liability that we or they may suffer as a result,
    directly or indirectly, of any breach by you of these T&C's.


Why you need to stick to these T&C's

If there is a change in the law or any regulation limiting our ability to provide the Site or the Service, or if we consider that you have breached any of these T&C's or otherwise behaved inappropriately when using the Site or any service on the Site we reserve the right to:

  • close your Mobytec account(s), and/or delete any information you may have stored; and
  • take measures (including terminating, suspending or restricting your access) to prevent
    you from using the Site.

As part of the payment process, you will be required to enter into a separate agreement with our payment processor (PayPal). This will be between you and PayPal and you agree to use the service in accordance with any instructions PayPal gives you.

All prices displayed on the Site include UK VAT.

You warrant to us that the details you provide while using the Site are correct and that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of all the products and services that you attempt to purchase with that card.

By registering with us, you agree to pay on time any fees, tariffs or other charges for subscriptions, text bundles and any other chargeable product.

We reserve the right to cancel any order on the rare occurrence that, acting reasonably, we suspect any type of fraudulent activity.

We reserve the right, at our sole discretion, to change, modify, add or delete our service(s) at any time. This includes pricing of any paid-for services or products that we offer.


All about copyright and trade marks

The Mobytec name and logos belong to IMImobile SAT and may not be used without our written permission. The CPP Data Backup name and logos belong to Vanquis Bank Limited and may not be used without their permission.

Also, all copyright, trade mark rights, database rights, patent rights and any other intellectual property rights in text, graphics, audio, video or image files, content, software, data and information displayed on, or available from the Site belong to or are licensed by us. This includes the organisation and layout of the site and the underlying software owned by us or our licensors and suppliers. You agree that all these materials are available for your personal use only, and you may not copy, modify, alter, publish, broadcast, distribute, sell or transfer any such materials without our written permission except for the sole purpose of viewing the Site's content. This includes electronic reproduction by uploading or downloading. For the avoidance of doubt, anything printed will form part of the content of the Site.

Mobytec uses Funambol, Inc’s Sync ML DS Server v7.0 for PIM Sync – “Powered by Funambol”.


Disclaimer of liability

The Site and the Services are provided 'as is'. We explicitly disclaim all warranties of any kind, whether stated or implied. Your statutory rights are not affected.

It's important to note that using the Internet has its dangers. We take reasonable steps to ensure a fast, reliable and secure service, but we can't be held responsible for any damage, loss or corruption of any data, information or material or viruses that may infect your computer equipment or other property.

We are not responsible for any loss, claim or damage including but not limited to lost profits, lost savings or revenue, or loss or corruption of data or information or any indirect, incidental or consequential damages of any kind which arise out of or are in any way connected with your use or misuse of the Site even if we have been advised of the possibility of damage. Your use of the Site includes your use of information, products or services obtained through the Site.

Nothing in these T&C's excludes or limits our liability to you for death or personal injury arising from our own negligence.

From time to time we may need to maintain the software and other equipment that runs the Site. During these times you may not be able to access the Site or things may be a bit slower than normal. If this happens please take a short break and try again later.

Unless specifically stated otherwise, we are not liable for information on the Site and we make no warranty in respect of its timeliness, accuracy or availability.

We are not responsible for the compatibility of the Site with your phone, computer system, software and/or hardware.

We make no promises of any kind about the suitability, reliability, timeliness, and accuracy of the services offered on this Site for any purpose.

If you are dissatisfied with any part of the Site, or with any of these T&C's, your sole remedy, except as specifically provided in these T&C's, is to stop using the Site.


Linking up

We may provide links to other websites which we hope you will find useful. If you use these links to access other websites, you will be leaving the CPP Data Backup Site. We won't be responsible or liable for the content, advertising or products or services available from such sites or, for any dealings that you may have, or the consequences of such dealings, with the operators of those websites. Should a dispute arise between you and any third party, we might be able to help you resolve it, but we can't be responsible for any loss or damage.

Some other sites may contain content that is inappropriate for younger visitors. Where a site indicates that content is suitable only for those of a certain age, visitors below that age are encouraged not to link to and are not welcome to visit such sites or areas of such sites.

The Site may contain advertisements. We are not responsible for and do not endorse the content of such advertisements, and do not accept any responsibility for any errors or inaccuracies in advertising material.


Let's hope it never happens, but...

In case of force majeure, bankruptcy, liquidation or similar events we reserve the right to close the Site and the Service at any time, temporarily or permanently.


Keeping up to date

These T&C's may be amended, updated or modified by us from time to time, so it's a good idea to keep checking back here to stay up to date. You agree to remain bound at all times by these T&C's as amended, updated or modified in connection with your use of the Site or the Service.

From time to time you may be asked to register your details with us in order to receive products or services or to enter competitions. When you do, additional terms and conditions will apply.


General

We reserve the right to monitor and track your visits to the Site.

Our use of your personal details is subject to our Privacy Policy.

A failure or delay by us in enforcing compliance with these T&C's shall not be a waiver of that or any other provision of these T&C's.

None of these T&C's shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any third party.

If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These T&C's constitute the entire agreement between you and us as to your use of the Site and shall supersede any prior agreement or representation in respect thereof.

The express provisions of these T&C's are in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are excluded to the fullest extent permitted by law.

All notices to be given by us to you in connection with these T&C's shall be sufficiently given when forwarded by email addressed to you at the email address you have given us.

English law governs these T&C's. You agree to submit to the non-exclusive jurisdiction of the English courts.
